El consentimiento en el proceso penal : ¿un oxímoron?

2021

We are involved in a moment of deep changes in Criminal Procedure due, among other reasons, to the permanent expansion of Criminal Law. Legislative modifications have taken place one another over the world and they have led to a functional reformulation of the role played by the protagonists of Criminal Procedure. These changes have not finished yet and the future is still to come, but new elements are already emerging: the consent of the actors of the process and of the victims and the reinforcement of the principle of opportunity are undoubtedly some of them. Probation, diversion, compliance, criminal mediation are institutions that stand on the principle of consent for procedural purpose…

Fattispecie indennitaria e danno da processo penale

2017

Analoghe forme…

Conflicts of Jurisdiction in Criminal Proceedings in Europe: Between Bis In Idem and Lis Pendens

2019

The purpose of this paper is to highlight the main issues concerning conflicts of jurisdiction within the EU, also from an italian perspective . The reason of conflicts of jurisdiction’s increase lies in the non-full application of the territoriality criterion, but especially in the transformation of criminality: the opening of borders and free movement of people, as well as the using of IT tools, can cause a fragmentation, among different countries, in the commission of crimes. The discussion on the overlap of proceedings for the same facts involving the same person revolves around various sources of law. Because of interpretative difficulties, many questions regarding conflicts of jurisdi…

2021

Artykuł poddaje analizie instytucję zabezpieczenia na nieruchomości w postępowaniu karnym w kontekście połączenia w niej działania organów postępowania karnego w dwóch różnych procedurach i w dwóch różnych pozycjach procesowych. Zabezpieczenie następuje w zakresie tytułu wykonawczego w postaci stosownego postanowienia i wynika z postępowania karnego w fazie in personam. Tytuł wykonawczy uzyskany w procedurze karnej stanowi podstawę wpisu hipoteki przymusowej według regulacji procedury cywilnej do księgi wieczystej. Umorzenie postępowania karnego na podstawie art. 59a k.k. – wybrane zagadnienia

2016

Discontinuation of proceedings under Article 59a of the Criminal Code is a new institution in Polish criminal law. This article discusses selected issues relating to the premises for the application of Article 59a of the Criminal Code in practice. In view of the use by the legislator in Article 59a of the Criminal Code of concepts with vague meanings, their possible interpretations were proposed. It has been suggested that a rephrasing of the provision in ąuestion should be considered, in order to ensure the possibility of applying the said institution to a wider range of misdemeanours, as compensatory discontinuation is intended by the legislator to fulfil the redress function of proceedin…

La regola di giudizio nel patteggiamento tra cursus ordinario e revisione

2022

The article aims to deepen a fundamental and much debated profile in relation to the special rite of the Italian patteggiamento. In particular, the Author, in the light of an analysis of the undoubted particularities of the judicial mechanism of application of penalty upon request of the parties, intends to focus on the essence and the operation that the judgment rule assumes, respectively, in the ordinary cursus of criminal proceeding and in therevision, trying to offer an interpretative reconstruction that is able to reconcile the (substantial) needs of justice and the (formal) reasons for systematic coherence.

Zakres kognicji sądu w postępowaniu o wydanie wyroku łącznego. Glosa do postanowienia Sądu Najwyższego z 25.02.2020r., IV KK 78/19

2021

The commentary discusses the scope of the court's jurisdiction in the proceedings to issue a cumulative judgment. The author agrees with the Supreme Court's view that, in its cumulative judgment, a court should neither assess whether individual penalties imposed under separate judgments are correct, nor should it analyse the extent of culpability and the social harm caused by the acts. This is because the court's rulings on those matters, which are contained in the individual convicting judgments, are fina/ and binding. In the proceedings on issuing a cumulative judgment, the court only rules on what the cumulative pena/ty, which will ultimately be enforced, will be, white considering the i…

Prace nad kodyfikacją prawa karnego procesowego w Polsce w latach 1919–1928

2020

In his contribution, the author presents the work on the codification (initially on the Act) of procedural criminal law in Poland in the years 1919–1928. Those works were initially led by the Criminal Department of the Codification Committee, and then by the Criminal Proceedings Section of the Codification Commission. The first period of the work on the criminal procedure law was characterized by some disputes between the members of the Department, i.e. supporters of the classical school (E. Krzymuski) vs. the sociological school (J. Makarewicz), the discussion aiming at defining the relationship of procedural criminal law and substantive criminal law. The work on the draft law was carried …
